1. SCOPE AND VALIDITY OF THE TERMS

​

1.1 These general and ordering conditions of the e-shop of Siim Oja Kool OÜ (hereinafter the Seller) (hereinafter referred to as the Conditions) apply to all persons (hereinafter the Buyer) who use the www.treeningrihm.ee e-shop (hereinafter the e-shop) and order e -shop goods (hereinafter Goods).

2. PURCHASE OF GOODS AND PLACING AN ORDER IN THE E-SHOP

2.1 To start shopping from the e-store, press the "Go to buy" button to go to the Shopping Cart page. The quantity of the Goods in the shopping cart can be changed. The price of the Goods and the availability of the Goods may change on an ongoing basis and without prior notice. If the Buyer has placed the order before the price of the Goods has changed, the price valid at the time of the order will apply.

2.2 In order to confirm the order, the Buyer will be directed to the Buyer's data entry (Checkout) page to enter the required data. You will see a summary on the right to check, confirm and complete your order. Click "Continue" to confirm your personal information.

2.3 In order to order the goods, the appropriate delivery method must be selected. Details of the delivery method are requested on the order form page. By selecting “Free delivery to Omniva parcel machine”, the Goods will be sent to the nearest parcel machine according to the address entered by the customer. By selecting “Pick up myself” the Buyer will be contacted when the Goods are ready for delivery at Lelu, Loone village, Kohila parish, Rapla county 79831 Mon-Fri 10: 00-18: 00. Press "Continue" to confirm the delivery method. If you select "Courier home or ontour", the parcel will be sent to the entered address.

2.4 The buyer can use a credit and debit card to pay for his purchase by entering the card details in the boxes (Visa, MasterCard, American Express, etc.) or a manual payment solution. Using the manual payment solution, we will issue an invoice to the Buyer by e-mail. Click "Continue" to confirm the Payment option.

2.5 After reading these Terms and Conditions and the Privacy Policy and Return Policy, please confirm your acceptance of them on the next page by ticking the "Terms". Click "Place order" to confirm your purchase.

 

2.6 In case of a credit or deposit card payment solution, the Buyer will be directed to confirm the payment.  

 

3 PAYMENT FOR GOODS

 

3.1 It is possible to pay for the goods with a credit and deposit card (Visa, MasterCard, American Express, etc.) or by choosing the “manual payment” option. After making the payment, the e-shop will send the Order confirmation and invoice to the Buyer. The card payment service is provided by Fibonatix (DE) GmbH. In case of manual payment, an e-mail will be sent to the Buyer, by clicking on the link added to the e-mail you can make the payment via Estonian bank links (Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele (with payment initiation service), Pocopay). Bank links are mediated by Maksekeskus AS).


3.2 All personal data that has become known in the course of visiting the Siim Oja Kool OÜ e-store and making purchases shall be treated as confidential information. The encrypted data communication channel with the payment solution providers ensures the security of the Buyer's personal data and bank details and shall be governed in accordance with the laws of Estonia. Representatives of Siim Oja Kool OÜ do not have access to the respective encrypted data.

4 PRODUCT DELIVERY

4.1 The goods will be delivered in the delivery method selected by the Buyer within 1-3 working days. Due to the large parcel volume, it may take longer than usual for parcels to arrive. The delivery of goods is performed with Omniva parcel delivery services. You can find out more about the services of the parcel machine on their website https://www.omniva.ee/era/pakk. When entering data, be careful and accurate so that the goods arrive at the right time, in the right place.

4.2 In case of broken packaging, the Buyer can refuse to accept the shipment and / or immediately notify the customer service of Siim Oja Kool OÜ at the e-mail address info@treeningrihm.ee.

5 RIGHT OF WITHDRAWAL

 

5.1 The buyer has the right to withdraw from the purchased goods within 14 days of receiving the product.


5.2 The Buyer has the right to cancel his order after payment for the Goods, but before delivery of the Goods without additional costs. To cancel the order, the Buyer must send a notice with the order number to the e-mail address treeningrihm@siimojakool.ee. A confirmation of the cancellation of the order will be sent to the Buyer. The product order can also be canceled upon receipt (see section 5.3).

5.3 The costs of returning the goods shall be borne by the Buyer, unless the reason for the return is due to the fact that the product to be returned does not correspond to what was ordered (eg a defective product).

 

5.4 Upon receipt of the returned goods, Siim Oja Kool OÜ shall return to the Buyer immediately, but not later than after 14 days, all fees received from the Buyer on the basis of the contract.

6. PRINCIPLES OF DATA PROTECTION AND PROCESSING

​

6.1 The Seller guarantees the Buyer's data incl. in accordance with the terms of the privacy policy for the protection and use of personal data. Buyer confirms that it has read and agrees to the terms of the privacy policy. Pursuant to the applicable legislation and the provisions of the privacy policy, the Seller has the right to process data (including personal data) to the extent necessary for use in the e-shop without the consent of the Buyer. Among other things, based on the above, the Seller has the right, without separate consent: to send the Buyer notices related to the use of the e-store services, incl. messages sent in the interest of e-shop users; to maintain in order to better serve the Buyers, including within a reasonable time also for those orders that were not completed by the Buyer during the session.

6.2 If the Buyer has given consent to the marketing of the data by concluding the Customer Agreement or otherwise making the Buyer's consent (eg in self-service), the Seller shall use this data under the conditions and for the purpose set out in the privacy policy, including personal direct marketing, campaign and discount offers of services and goods. electronically (eg by e-mail or SMS).

6.3 The Buyer has the right to withdraw the consent given for the marketing use of the data at any time by sending a corresponding e-mail to the Seller or by following the instructions in the direct sales offer sent to his e-mail address to refuse to receive further direct sales offers.

7. LIABILITY AND SETTLEMENT OF DISPUTES

​

7.1 In case of non-conforming Goods (the Goods are defective), the Buyer has the right to submit claims to the Seller within 2 (two) years from the date of delivery of the Goods. The claim must be submitted immediately, but not later than within 2 (two) months from the discovery of the defect in the Goods. Upon discovering a defect, the Buyer must take reasonable measures to preserve and protect the Goods, including not using the defective Goods if the use of the Goods further worsens the condition of the Goods.

7.2 In the event of non-compliance of the Goods with the terms of the contract, the Buyer may rely on the legal remedies provided by law, including demanding repair, replacement of the Goods and return of the non-compliant Goods.

7.3 Siim Oja Kool OÜ shall not be liable for the deterioration / damage of the Goods due to the fault of the Buyer, for defects that have arisen as a result of improper use of the Goods, for normal physical wear and tear of the Goods in normal use.

7.4 If a sales guarantee has been given for the Goods by the Seller or the manufacturer, the warranty conditions shall be given to the Buyer in writing together with the Goods and / or they shall be made available electronically in the e-shop.

7.5 Complaints related to the Goods purchased from the e-store can be submitted to the address Siim Oja Kool OÜ e-shop Laane, Loone, Kohila parish, 79831 Rapla county or by e-mail to info@treeningrihm.ee. 

7.6 Defective Goods must also be submitted with the claim.

7.7 The Seller ensures that the Goods sold in the e-shop comply with the standards in force in the European Union. The circumstances set out in these standards are not considered to be a defect of the Goods.

7.9 The Buyer has the right to apply to the competent supervisory authority, which is the Consumer Protection and Technical Surveillance Authority at Sõle 23A, 10614 Tallinn, e-mail: info@ttja.ee In order to resolve the dispute, the Buyer may apply to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Buyer and the Seller, which the parties were unable to resolve by agreement. 1. GENERAL PROVISIONS

​

1.1 This Privacy Policy governs the principles governing the collection, processing and storage of personal data. Personal data is collected and stored by the chief processor of personal data SIIM OJA KOOL OÜ (hereinafter data processor).

1.2 For the purposes of the Privacy Policy, a data subject is a customer or other natural person whose personal data is processed by a data processor.

1.3 For the purposes of the Privacy Policy, the Customer is anyone who purchases goods or services from the data controller's website.

2. COLLECTION, PROCESSING AND STORAGE OF PERSONAL DATA

Knowingly submitting false information is considered a violation of our privacy policy. The data subject is obliged to immediately notify the data processor of any changes in the submitted data.

2.4 The data processor shall not be liable for any damage caused to the data subject or to third parties caused by the submission of false data by the data subject.

3. PROCESSING OF CUSTOMERS 'PERSONAL DATA

3.1 The data processor may process the following personal data of the data subject:

(c) the processing of personal data is necessary for the performance of a legal obligation of the controller;

(f) the processing of personal data is necessary for the legitimate interests of the controller or of a third party, unless such interests outweigh the interests or fundamental rights and freedoms of the data subject for the protection of personal data, in particular where the data subject is a child.

3.5 The data processor has the right to share the personal data of customers with third parties, such as authorized data processors, accountants, transport and courier companies, companies providing transmission services. The data processor is the chief processor of personal data. The data processor forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

3.6 When processing and storing personal data of the data subject, the data processor shall implement organizational and technical measures to ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure and any other unlawful processing.

​

3.7 The data processor shall store the data of data subjects depending on the purpose of processing, but not longer than 2 years.

​

4. RIGHTS OF THE DATA SUBJECT

​

4.1 The data subject has the right to access and inspect their personal data.

​

4.2 The data subject has the right to receive information on the processing of his or her personal data.

​

4.3 The data subject has the right to supplement or correct inaccurate data.

​

4.4 If the data processor processes the personal data of the data subject on the basis of the data subject's consent, the data subject has the right to withdraw the consent at any time.

​

4.5 The data subject can contact the customer support of the e-store at info@siimojakool.ee to exercise their rights.

​

4.6 In order to protect his or her rights, a data subject may submit a complaint to the Data Protection Inspectorate.

5. FINAL PROVISIONS

​

5.1 These data protection conditions have been drawn up in accordance with Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC Protection Act and legislation of the Republic of Estonia and the European Union.

5.2 The data controller has the right to change the data protection conditions in part or in full by notifying the data subjects of the changes on the website.  www.treeningrihm.ee and / or www.siimojakool.ee .
